Student Financial Responsibility Agreement

    General Provisions
    I understand when I register for any class at Kentucky Wesleyan College or receive any service from Kentucky Wesleyan College, I accept full responsibility to pay all tuition, fees, and other associated costs assessed as a result of my registration and/or receipt of services. I further understand that my student account reflects a balance I owe for educational services obtained and the associated costs of attending Kentucky Wesleyan College.

    The College is an institution of higher education and as such, all or portion of my student account is considered to be an educational loan offered for the sole purpose of financing an education and is not dischargeable in bankruptcy proceedings.(as defined by the U.S. Bankruptcy Code at 11 U.S.C. §523(a)(8)) This agreement will be in effect until I have fulfilled all financial obligations to Kentucky Wesleyan College and the College has terminated the agreement.
    Repayment
    I promise to pay Kentucky Wesleyan College the principal and any late fees, fines or penalties by the due dates stated on my student account and in applicable college catalogs, registration guides and websites. If I expect financial aid to pay all or part of my financial obligations to Kentucky Wesleyan College, I understand that it is my responsibility to meet all requirements for disbursement to my student account by the stated due dates.

    I authorize Kentucky Wesleyan College to use the financial aid to pay for all education costs charged to my student account for my entire period of enrollment or attendance at the college. I understand that it is my responsibility to ensure that all requirements of grantors, lenders, employers, and other third-party payers are met on a timely basis. I understand that despite my expectations for payment from financial aid or other sources, I am ultimately responsible for all charges incurred. I further understand that my financial aid may be adjusted due to eligibility. I agree to pay back to Kentucky Wesleyan College any amounts for which I am not eligible under applicable financial aid guidelines.

    In the event that financial aid is reduced or cancelled, or I have not met the specific requirements for such aid I will become responsible for the full balance of outstanding charges.
    Method of Communication
    I understand and agree Kentucky Wesleyan College uses e-mail as an official method of communication with me, and I am responsible for reading the e-mails I receive from Kentucky Wesleyan College on a timely basis.
    Contact
    I authorize Kentucky Wesleyan College and its agents and contractors to contact me at my current and any future cellular phone number(s), email address(es) or wireless device(s) regarding my delinquent student account(s)/loan(s), any other debt I owe to Kentucky Wesleyan College, or to receive general information from Kentucky Wesleyan College.

    I authorize Kentucky Wesleyan College and its agents and contractors to use automated telephone dialing equipment, artificial or pre-recorded voice or text messages, and personal calls and emails in their efforts to contact me. Furthermore, I understand that I may withdraw my consent to call or text my cellular telephone using automated telephone dialing equipment by submitting a clear revocation request in writing to the Dir. of Student Accounts Office or in writing to the applicable contractor or agent contacting me on behalf of Kentucky Wesleyan College.
    Updating Contact Information
    I understand and agree that I am responsible for keeping Kentucky Wesleyan College records up to date with my current mailing addresses, email addresses, and phone numbers by following the procedure online at Kentucky Wesleyan College Student Portal.

    Upon leaving Kentucky Wesleyan College for any reason, it is my responsibility to provide Kentucky Wesleyan College with updated contact information for purposes of continued communication regarding any amounts that remain due and owing to Kentucky Wesleyan College.
    Method of Billing
    I understand Kentucky Wesleyan College uses mail as its official billing method, and I am responsible for viewing and paying my student account bill by the scheduled due date. I further understand failure to review my bill does not constitute a valid reason for paying my bill after the due date. Student account billing information is available online at Kentucky Wesleyan College Student Portal under “My Ledger”.
    Billing Errors
    I understand administrative, clerical, or technical billing errors do not absolve me of my financial responsibility to pay the correct amount of tuition, fees, and other associated financial obligations assessed as a result of my registration at Kentucky Wesleyan College.
    Returned Payments/Failed Payment Agreements:
    If a payment made to my student account is returned by the bank for any reason, I agree to repay the original amount of the payment plus a returned payment fee of $40.00. I understand multiple returned payments and/or failure to comply with the terms of any payment plan or agreement I sign with Kentucky Wesleyan College may result in cancellation of my classes and/or suspension of my eligibility to register for future classes at Kentucky Wesleyan College.
    Late Payment Charge
    I understand and agree if I fail to pay my student account bill or any monies due and owing Kentucky Wesleyan College by the scheduled due date, Kentucky Wesleyan College will assess late payment and/or finance charges at the rate of 1% per month on the past due portion of my student account until my past due account is paid in full.
    Financial Hold
    I understand and agree if I fail to pay my student account bill or any monies due and owing Kentucky Wesleyan College by the scheduled due date, Kentucky Wesleyan College may place a financial hold on my student account, preventing me from registering for future classes or receiving my diploma. If I wish to request a transcript I may do so via the National Student Clearinghouse, however, If I have a financial hold I will be asked additional information regarding repayment options.
    Collection Agency Fees
    I understand and accept if I fail to pay my student account bill or any monies due and owing Kentucky Wesleyan College by the scheduled due date and fail to make acceptable payment arrangements to bring my account current, Kentucky Wesleyan College may refer my account to a collection agency. If Kentucky Wesleyan College refers my account balance to a third party for collection whether an attorney or collection agency, my account will be reported to national credit bureaus and I will be responsible for any costs (including, but not limited to collection fees) associated with attempting to collect the monies due and owing. I understand a collection fee will be assessed and will be due and owing in full at the time of the referral to the third party. The collection fee will be calculated at the maximum amount permitted by applicable law, but not to exceed 40% of the amount outstanding. For purposes of this provision, the third party may be a debt collection company or an attorney. If a lawsuit is filed to recover an outstanding balance, I will also be responsible for any costs associated with the lawsuit such as court costs, attorney’s fees, or other applicable costs. Finally, I understand my delinquent account may be furnished to one or more of the national credit bureaus.
    Drop/Withdraw
    I agree if I drop or withdraw from some or all the classes for which I register, I will be responsible for paying all or a portion of tuition and fees in accordance with the published tuition refund schedule in the Academic Bulletin. I have read the terms and conditions of the published tuition refund schedule and understand those terms are incorporated herein by reference. I further understand my failure to attend class or receive a bill does not absolve me of my financial responsibility as described above.

    If I decide to completely withdraw from Kentucky Wesleyan College, I will follow the instructions included in the Academic Bulletin which I understand and agree are incorporated herein by reference.
    Financial Aid
    I understand aid described as “estimated” on my Financial Aid Award does not represent actual or guaranteed payment. I understand it is an estimate of the aid I may receive if I meet all requirements stipulated by that specific aid program. I understand my Financial Aid Award is contingent upon my continued enrollment and attendance in each class upon which my financial aid eligibility was calculated. If I drop any class before completion, I understand my financial aid eligibility may decrease and some or all of the financial aid awarded to me may be revoked. If some or all my financial aid is revoked because I dropped or failed to attend a class, I agree to repay all revoked aid disbursed to my account and resulted in a credit balance refunded to me. I agree to allow financial aid I receive to pay any and all charges assessed to my account at Kentucky Wesleyan College, such as tuition, fees, campus housing and meal plans, student health insurance, parking permits, service fees, fines, bookstore charges, or any other amount, in accordance with the terms of the aid.

    I further understand any federal Title IV financial aid I receive, except for Federal Work-Study wages, will first be applied to any outstanding balance on my account for tuition, fees, and room and board. Title IV financial aid includes aid from the Pell Grant, Supplemental Educational Opportunity Grant (SEOG), Direct Loan, PLUS Loan, Perkins Loan, and TEACH Grant programs. I authorize Kentucky Wesleyan College to apply my Title IV financial aid to other charges assessed to my student account such as student health insurance, parking permits, bookstore charges, service fees and fines, and any other education related charges. I further understand this authorization will remain in effect until I rescind it and I may withdraw it at any time by submitting a clear revocation request in writing to the Kentucky Wesleyan College Financial Aid Office.
    Prizes, Awards, Scholarships, Grants
    I understand all prizes, awards, scholarships, and grants awarded to me by Kentucky Wesleyan College will be credited to my student account and applied toward any outstanding balance. I further understand my receipt of a prize, award, scholarship, or grant is considered a financial resource according to federal Title IV financial aid regulations and may therefore, reduce my eligibility for other federal and/or state financial aid (i.e., loans, grants, Federal Work-Study) which, if already disbursed to my student account, must be reversed and returned to the aid source.
    Privacy Rights and Responsibilities:
    I understand Kentucky Wesleyan College is bound by the Family Educational Rights and Privacy Act (FERPA) which prohibits Kentucky Wesleyan College from releasing any information from my education record without my written permission. Therefore, I understand if I want Kentucky Wesleyan College to share information from my education record with someone else, I must provide written permission by following the procedure outlined in the Kentucky Wesleyan College Student Portal. I further understand I may revoke my permission at any time as instructed in the same procedure.
    IRS Form 1098-T
    I agree to provide my Social Security number (SSN) or taxpayer identification number (TIN) to Kentucky Wesleyan College upon request as required by Internal Revenue Service (IRS) regulations for Form 1098-T reporting purposes. If I fail to provide my SSN or TIN to Kentucky Wesleyan College, I agree to pay any and all IRS fines assessed as a result of my missing SSN/TIN.

    I understand that Kentucky Wesleyan College has the Third-Party Provider Heartland ECSI process my annual IRS Form 1098-T and a paper copy of my Form 1098-T will be mailed to my billing address on file with Kentucky Wesleyan College, however an electronic copy may also be obtained
    at https://heartland.ecsi.net/index.html after January 31st.
    A word about Health and Safety
    Health and safety are Kentucky Wesleyan College’s top priorities. If necessary, the campus is prepared to make a decision to move to a hybrid or fully remote learning environment in order to support the health and safety of the campus community. No matter the instruction mode, students will receive the full and accredited Kentucky Wesleyan College curriculum using the latest instructional design modalities and tools to maximize engagement between students, their peers and professors. If changes are made to class instruction mode for any reason, tuition will not be adjusted.
    Entire Agreement
    This agreement supersedes all prior understandings, representations, negotiations and correspondence between the student and Kentucky Wesleyan College, constitutes the entire agreement between the parties with respect to the matters described, and shall not be modified or affected by any course of dealing or course of performance. This agreement may be modified by Kentucky Wesleyan College if the modification is signed by me. Any modification is specifically limited to those policies and/or terms addressed in the modification.
    Severability Clause
    If any provision, term, or clause of this Agreement is declared illegal, unenforceable, or ineffective in a legal forum with competent jurisdiction to do so, this Agreement shall be deemed severable, and all other provisions, terms, and clauses of the Agreement will remain valid and binding on the Parties.
    Agreements
    I hereby indicate my intent to be bound by this agreement. I also acknowledge and accept full financial responsibility to pay for the cost and expense of all tuition and all related educational services, fees and expenses associated with my receipt of educational services at Kentucky Wesleyan College, even if course modality (online, remote, hybrid, in-person) changes or circumstances result in modification, termination, or suspension of some services.
     
    I hereby indicate my intent to be bound by this agreement. I also acknowledge and accept full financial responsibility to pay for the cost and expense of all tuition and all related educational services, fees and expenses associated with my receipt of educational services at Kentucky Wesleyan College, even if course modality (online, remote, hybrid, in-person) changes or circumstances result in modification, termination, or suspension of some services.
